1) Scope
The deliveries, services and offers of FLORAMALL are exclusively based on these terms and conditions, even if they are not expressly agreed upon. With the order of flowers and/or plants, these conditions are considered accepted.

2) Flowers, Plants

We try to deliver your order as shown in the webshop. However, flowers and plants are seasonal natural products and may vary slightly depending on the season. A FLORAMALL bouquet may therefore look slightly different from the picture.

3) Prices
The prices listed in the offer at the time of the order shall apply. The delivery costs for PostPac Priority are CHF 9.90 (Saturday +CHF 4.90). 

4) VAT
All prices for deliveries within Switzerland include VAT. 

5) Deliveries
Within Switzerland, the delivery to all locations is guaranteed and delivery takes place on the desired delivery date by Swiss Post between 8am and 6pm. Deliveries at a certain time are not possible. In some cases, there may also be a delay by the Swiss Post, for which we do not take any guarantee.  Sundays and public holidays no deliveries are made. Mother's Day orders are executed on the Saturday before Mother's Day. If Valentine's Day falls on a Sunday, these orders will also be delivered on Saturday. 

6) Subscriptions
You can order flower subscriptions for yourself or for another person. We can deliver them on a weekly, every two weeks or on a monthly basis on any day of the week. The subscription is valid until you cancel it. You can cancel it at any time within your chosen delivery method two working days before delivery.

7) Correctness of the delivery address
Please check carefully that the delivery address is complete and correct. We can not accept liability for late or non-delivery due to an incorrect or incomplete address. 

8) Order confirmation
For each order you will receive an order confirmation by e-mail within a few minutes with your order number and detailed information about the purchased product. Please do not hesitate to contact our customer service if you have not received an order confirmation.

10) Changes or cancellations of orders
Changes or cancellations are possible without any additional charge up to two working days before the delivery date. Late changes or cancellations cannot be refunded.

11) Privacy
FLORAMALL shall be entitled to process the data about the buyer received in relation to the business relationship or in connection with it, regardless of whether these data originate from the buyer himself or from third parties, in accordance with the Federal Law on Data Protection (DSGVO). Personal data of private customers will be treated confidentially and will only be passed on to third parties within the scope of credit assessment.

11) Information about the EU Dispute Settlement Body
The EU Commission provides a platform for online dispute resolution on the Internet under the following link: https://ec.europa.eu/consumers/odr/
(note pursuant to §36 of the Consumer Dispute Resolution Act (ODR)). FLORAMALL does not participate in any dispute resolution proceedings with a consumer dispute resolution body within the meaning of the ODR. There is no legal obligation to do so. 

12) Jurisdiction and applicable law
Zurich, Switzerland is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
